These Terms of Service (“Terms”) govern your use of Drive Your Way (the “Service”), operated by BlueHealthUS, Inc.. By accessing or using the Service, you agree to these Terms.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
Your account
You are responsible for activity under your account and for keeping your login secure. You must provide accurate information and notify us of any unauthorized use.
License to play
We grant you a personal, non-exclusive, non-transferable, revocable license to access and play the Service for personal, non-commercial use, subject to these Terms and the EULA.
Virtual items and currency
The Service may include virtual items and in-game currency (for example, gems). These have no real-world monetary value, are licensed not sold, are non-transferable, and cannot be redeemed for cash. We may modify or discontinue virtual items, subject to applicable law.
Purchases and billing
Purchases are sold by BlueHealthUS, Inc. and processed by Stripe, Inc., our payment processor, which handles payment processing and billing. Prices and availability may change. Purchases are subject to our Refund Policy. The Service follows a fair-play, no pay-to-win model: purchases are limited to cosmetic and convenience items and do not grant competitive rating advantages.
Advertising
The Service may display third-party advertising. We do not endorse and are not responsible for advertised products or services. Ad availability, fill, and content are provided by third parties and are not guaranteed. Engaging with rewarded ads is optional; reward delivery is governed by these Terms and the in-game rules.
Acceptable use
You agree not to cheat, use bots or unauthorized automation, exploit bugs, reverse engineer the Service, disrupt other players, or use the Service for unlawful purposes.
Intellectual property
The Service and its content are owned by BlueHealthUS, Inc. or its licensors and are protected by intellectual-property laws. These Terms do not grant you rights in our trademarks or content except as expressly stated.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, BlueHealthUS, Inc. will not be liable for indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing limits liability that cannot be excluded under applicable law.
Termination
We may suspend or terminate access for breach of these Terms or to protect the Service. You may stop using the Service at any time.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your country apply.
Changes
We may update these Terms. Material changes take effect when we post the updated Terms and update the date above.
